Arbitration
What is arbitration?
Arbitration is a kind of private justice enshrined in the law, an alternative to governmental justice. In the case of arbitration, parties do no submit their dispute(s) to the usual judge, but to one or more expert arbitrators. These arbitrators subsequently make a decision which is binding to both parties.
The advantages of arbitration compared to governmental justice include: the specific know-how and experience of arbitrators, a shorter procedure, confidentiality (an arbitration procedure is not a public one), no obligatory legal representation and fewer formalities.
Arbitration by Krans & van Hilten
Krans & van Hilten is in charge of the secretariat of the Foundation Arbitration Board for the Metal Trade and Industry. The purpose of this foundation is to settle disputes related to the metal, electrical, electronics and synthetic materials industries as well as trade in the products of these industries and associated sectors. The foundation is able to call in sixty different arbitrators who possess special expertise in the fields in which the disputes submitted to the Foundation, take place.
Way of working
Being the secretariat of the foundation means, among other things, that the entire legal representation in the arbitration procedures reported to the foundation, will be performed through Krans & van Hilten. The resulting activities are mainly carried out by Nanette Mulder, after consultations with and under the responsibility of J.P. (Jan Peter) van den Berg LL.M., the secretary of the foundation. Deputy secretaries are M.S. (Machteld) Verboom LL.M. and R.W. (Roderick) Keus LL.M.
In every one of the foundation's arbitration procedures, one of these lawyers acts as secretary to the arbitrator(s). The secretary has an advisory vote and advises the arbitrator(s) in particular about the legal aspects of a dispute. The secretary is present during the verbal hearing of the arbitration procedure and draws up a draft sentence after having consulted the arbitrator(s).
Our lawyers, as (deputy) secretaries, have an independent and impartial position in the arbitration procedure. Their insight and their broad view resulting from such a different approach, present an added value to their work as a lawyer.
